Shadowmap's Partner Program Terms of Service

We recommend to read these Terms of Service (“Terms”, “Terms of Service”) carefully before entering an affiliate partnership with Shadowmap.
These Terms let you know what to expect when becoming a Shadowmap partner, to make the process of working with us as clear and straightforward as possible.
By becoming a Shadowmap affiliate partner, a legal contract is formed between you and Shadowmap (“the Owner”, “We”, “Us”). You indicate that you understand and agree to these Terms, and are of legal capacity to enter into a contract.
If you don’t agree to these Terms, you may not promote and make a profit from selling Shadowmap.
For better understanding and complete transparency, please note that our paid subscriptions are differentiated into Shadowmap Explorer, Shadowmap Home & Shadowmap Studio. The Terms of Service apply to all Shadowmap Technologies GmbH subscriptions.
Self-referrals are not Allowed
You are not permitted to sign up for Shadowmap through your own affiliate link. If we detect any self-referrals, your account will be permanently banned and any commission earned will be forfeited.
Abuse or Attempting to Mislead
We do not tolerate attempts to abuse our affiliate system. Any attempt to mislead, manipulate or defraud us or potential customers will result in your account being permanently banned. This includes posting fake discounts to coupon-sharing websites or engaging in any other activity that violates our policies.
No Search Engine Ads, Facebook Ads, or Other Ads That Compete With our own Marketing
You are not allowed to run any search engine ads (especially on branded terms or domain names), Facebook ads, or other ads that would compete with our own marketing and potentially cause confusion for customers. We reserve the right to terminate your account if we detect any such activity.
No Pretending to be Acting on Behalf of us (i.e. as an Employee)
You are not allowed to impersonate us or pretend to be acting on our behalf. This includes posing as an employee or representative of our company.
Intellectual Property
Shadowmap and its original content, features and functionality are and will remain the exclusive property of the Owner.
Changes to the Terms of Service
We reserve the right to change the Terms of Service for our partner program at any time. We will provide notice of any changes to the Terms of Service on our website, and it is your responsibility to review the changes and comply with the updated terms.
Termination
By participating in our affiliate program, you agree to comply with these terms and conditions. We reserve the right to terminate your participation in the Program at any time and for any reason if you violate these terms.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and the Owner regarding Shadowmap, and supersede and replace any prior agreements that may have been made between you and the Owner regarding Shadowmap.
